What is Domestic Violence?

Section 71.004(1) of the Texas Family Code defines domestic violence as:

“an act by a member of a family or household against another member of the family or household that is intended to result in physical harm, bodily injury, assault, or sexual assault or that is a threat that reasonably places the member in fear of imminent physical harm, bodily injury, assault, or sexual assault, but does not include defense measures to protect oneself.”

Many crimes can fit under the umbrella of domestic violence, including:

  • Any offensive physical contact, even if it does not result in bodily harm, can be considered assault, unless it was done in defense of one’s self. Threats that could reasonably be considered credible are another form of assault.
  • Intentionally or knowingly abducting another person. Charges increase in severity if the kidnapping was done in an attempt to terrorize the victim, if weapons were involved, or if the victim was physically or sexually abused during the kidnapping.
  • Sexual Assault. Any non-consensual, unwanted sexual contact against another person involving penetration. This includes contact through physical force, threats of violence, coercion, and even manipulation.
  • Unlawful Restraint. Restricting a person’s movements without consent … by moving the person from one place to another or by confining the person. Restraint is “without consent” if it is accomplished by force, intimidation, or deception.
  • Communication that is designed to harass, annoy, alarm, abuse, torment, or embarrass another person. This includes threats of harm, obscene phone calls, falsely reporting the death of a loved one, and more.
  • Stalking occurs when someone, on at least two occasions, knowingly or reasonably should know that his or her actions or behavior will be considered threatening or cause another person to have concerns about bodily injury or death.

 

Penalties for Domestic Violence

The penalties for domestic or family violence depend on the actual charges brought against the offender. They can include jail time, fines, or both.

Under Texas law, misdemeanors and felonies are punished as such:

  • First Degree Felonies. 5-99 years in prison, up to a $10,000 fine.
  • Second Degree Felonies. 2 – 20 years in prison, up to a $10,000 fine.
  • Third Degree Felonies. 2 – 10 years in prison, up to a $10,000 fine.
  • State Jail Felonies. 3 months – 2 years in a state jail, up to a $10,000 fine.
  • Class A Misdemeanors. Up to 1 year in the county jail, fine not to exceed $4,000.
  • Class B Misdemeanors. Up to 3 months in the county jail, fine not to exceed $2,000.
  • Class C Misdemeanors. Fine not to exceed $500.

Violating a protective order is a Class A misdemeanor. It becomes a third degree felony if the offender has been convicted of violating protective orders two or more times, or if they violated the order by committing assault or stalking.
