How Bail Process Works

If you or your loved one has been arrested for the first time, you might be overwhelmed with questions about what happens next. The bail process is overwhelming, but it’s simple once you break it down. Here’s what you can expect the process to look like, from the bail hearing to the rates and payment plans you could get from JBond Bail Bonds.

Step 1: Bail Hearing

Within 48 hours of an arrest, the court is obligated to hold a bail hearing for the defendant. This hearing is for the defendant, their legal team, and any possible co-signers to know their bail amount. The defendant should already have an attorney, either privately hired or a public defender, by the time the court hearing takes place. 

The bail amount is non-negotiable unless you file for a motion to modify bail. Fortunately, that doesn’t mean you or your co-signer have to pay the set amount.

Step 4: Processing and Release

Once the paperwork is processed and bail is posted, the defendant can finally be released and will need a ride home from jail. 

Step 5: Out on Bail

Once the defendant is out on bail, it’s important to comply with the terms of release. That means no traveling out of the country, no criminal activity, no drug use, and anything else you’re required to do by the court or your co-signer.

While out on bail, keep in touch with your bondsman and your legal team so they know you’re not violating the terms of your bail. Use this time to work on your defense, get extra work hours, take care of upcoming bills, or just be with your family.
